Terms and Conditions
Verstappen R. & Mardaga E. are specialist owners engaged in the rental of holiday-homes that it owns itself. For the purposes of this document it will be known as the Lessor.
1. Lessee
The People, Peoples or organization who contracts with Verstappen R. & Mardaga E. for the rental of one of their holiday-homes.
2. Booking
Confirmation by the prospective lessee of his, her or their requirements stating the details of the property, the required dates for it’s use and any additional services or facilities that are required. The confirmation must be in writing by fax, E-mail, letter or through the booking form. Any verbal enquiries will be recorded but reservations cannot be made except in writing. The written confirmation must be accompanied by the appropriate deposit. We will acknowledge receipt of satisfactory bookings and the deposit by fax or E-Mail. In the event of unsatisfactory bookings or properties which are fully let or any other unforeseen circumstances alternative accommodation will be offered or the deposit returned in full. Written confirmation of acceptance of the booking by Verstappen R. & Mardaga E. establishes the existence of a binding contract.
3. Binding Contract
The agreement between Verstappen R. & Mardaga E. and the lessee that has been established by the exchange of the confirmed booking and it’s acknowledgement.
4. Deposit
This is the non-refundable amount calculated at the rate of 25% of the total cost of the rental of the property or any other additional service such as car-hire that is provided by Verstappen R. & Mardaga E. This amount is payable for properties and services where a booking has been confirmed in writing and where the use of the property commences more than six weeks after the date of the booking.
5. Balance
This is the total cost of the hire of the holiday-home and any additional services which have been provided. This amount, less the amount of any deposit, becomes due for payment not later than six weeks prior to the agreed date for commencement of the lease.
Where a contract has been negotiated for the rental of a property where the commencement date of the lease is less that six weeks after the date of the agreed contract payment will be required in full on the date the contract is made.
6. Cancellations
All cancellations must be confirmed in writing not less than six weeks prior to the commencement of the lease of the holiday-home. Cancellations after this date may cause us to incur additional loss and expense which might amount to the full value of the contract that has been agreed. A penalty calculated on a sliding scale will be levied to compensate for this eventuality:
5 weeks notice of cancellation 80% of the total cost less deposit paid
4 weeks notice of cancellation 60% of the total cost less deposit paid
3 weeks notice of cancellation 40% of the total cost less deposit paid
2 weeks and less No refund
Any confirmation of cancellations must be in writing and in a format such as recorded postal delivery to avoid any possibility of the date of the cancellation being in doubt.
7. Payment
Payment can be made in Euro’s or Pounds Stirling by electronic bank transfer. The payment of any fees or charges levied for the bank transfer is the responsibility of the Lessee. We will provide an account number for this purpose which can be obtained by request.
8. Arrival
Except by prior agreement the holiday-home will be ready for us from 17.00 p.m. on the first day of the agreed rental period. The keys for the property will be handed over by Verstappen R. or Mardaga E. who will be available to assist in the unlikely event of there being any problems.
9. Departure
The property must be vacated by 09.30 a.m. on the final day of the agreed rental period. The keys are to be handed to our representative together with notification of any discrepancies due to breakages etc. that may have arisen during the rental period. The Lessee is reminded of his, her or their obligation to ensure the property and it’s inventory is in good order and that due respect for all the fixtures and fittings is shown at all times. The Lessee is liable and stands surety for all damages caused by the occupants or visitors to the property whilst it is in his, her or their possession for the whole of the rental period.
10. Insurance
We strongly recommend that suitable travel and health cover insurance is taken out with a reputable and experienced company.
11. Complaints
Any discrepancies or defects in the property or it’s fixtures and fittings must be brought to the owners (Verstappen R & Mardaga E.) attention within 24 hours after arrival at the property. Failure to comply with this requirement will be deemed as acceptance of the property as being satisfactory and in full compliance with the agreed contract.
12. Declaration
The submission of a firm booking in the manner prescribed earlier in these conditions will signify that the prospective Lessee fully understands and accepts these terms and conditions.
